Questions people ask

How is overtime calculated?

Under the federal Fair Labor Standards Act, non-exempt employees get 1.5 times their regular rate for every hour over 40 in a work week. At $20 an hour, overtime is $30 an hour, so 45 hours pays 40 × $20 + 5 × $30 = $950.

Is overtime daily or weekly?

Federal overtime is weekly. A few states add daily overtime: in California, hours over 8 in a day are paid at 1.5×, and hours over 12 in a day at 2×.

Who doesn't get overtime?

Exempt employees, generally salaried workers in executive, administrative or professional roles who meet salary and duties tests, aren't owed overtime under federal law.

Do holidays and sick days count toward 40 hours?

Under federal law, only hours actually worked count toward overtime, so paid time off usually doesn't. Some employers and union contracts count it anyway.
